Sentence Modification

The law Offices of Richard E. Cohen, located in Hartford, Connecgticut, frequently receives calls from people whose spouses, signifcant others and family members are incarcerated, asking how they can get sentences reduced for their loved ones. It is possible to get one’s sentence modified, although it is difficult. Sentence modifications are one vehicle, requesting that the court lower the sentence. The problem is that, if the sentence is three years or longer, the prosecutor on the original case has to approve the request before the application goes to the judge. And there has to be a pretty good reason for the request. Having an experienced criminal lawyer is extremely helpful in this type of situation. That lawyer has access to the prosecutor and the judge and can make his client’s case much more compelling than an application sent by an incarcerated prisoner.

At the Law Offices of Richard E. Cohen, located at 2 Congress Street in Hartford, Connecticut, we have helped many prisoners shorten their sentences. Attorney Richard E. Cohen has been a criminal defense attorney for almost twenty years and knows what might work on a sentence modification application. If you have a loved one in prison, filing a sentence modification is the best way to get him or her out of prison earlier.

Call Attorney Richard E. Cohen at 860-278-9366 for a free consultation and find out what can be done about getting the jail doors to swing open just a little earlier.

Should you go to trial?

After you’re arrested, your lawyer will attempt to plea bargain your case, getting the best offer he can from the prosecutor. Sometimes, that offer to plead guilty will be in exscchange for probation. Sometimes, the offer will include prison time, either because of the seriousness of the offense, the person’s record, or because prison time is mandatory. A person in that situation needs to decide whether to take the offer or go to trial, and either win, or lose and get a harsher sentence. At the Law Offices of Richard E. Cohen, we take this issue very seriously. After all, it’s a about a person’s life, not just a sum of money to be paid. Attorney Richard E. Cohen has gone to trial dozens of times, and has won many cases for his clients, thus preventing them from going to prison.

Cohen, located at 2 Congress Street, Hartford, Connecticut will analyze your situation and provide advise as to whether or not you should take the case to trial or take the plea offer. It’s a terribly important decision. Attorney Richard E. Cohen has practiced criminal law for almost twenty years and has the experience to help with that decision. Call The Law Offices of Richard E. Cohen at 860-278-9366 for a free consultation.

Carrying a Pistol Without a Permit

There is much to be said about this topic, but the fundamental point to be made here is that if you don’t have a gun permit, you can’t carry a handgun in Connecticut. There are exceptions for business and home, but in the car or on the street, unless you have a permit, no gun. If you are charged with carrying a pistol without a permit in Connecticut, you could receive up to five years in prison. And one year of that is nonsuspendable. That means you go to prison for one year. There is an exception. If the court finds mitigating circumstances, it can suspend all or part of the mandatory minimum one year. But there aren’t many reasons why the court would do this. So, if you are arrested for this crime, you need a lawyer. For an experienced criminal attorney, call the Law Offices of Richard E. Cohen at 2 Congress Street in Hartford, Connecticut.

Attorney Richard E. Cohen has been defending people charged with a crime for almost twenty years and has the experience and knowledge of the law to keep you out of jail if you’re arrested for carrying a gun. Arrest Warrants

Unlike what one sees on TV, police don’t just show up at a suspect’s house or confront him on the street to make an arrest. In Connecticut, police generally use arrest warrants to make – you guessed it -arrests. When a person becomes more than just “a person of interest”, the police prepare an application for an arrest warrant, listing all the reasons why they think there is “probable cause” that the person committed a crime. This is a pretty low standard, much lower than “guilt beyond a reasonable doubt”, for example. In other words, it’s an easy standard to meet. The police submit the application to the prosecutor, who reviews and signs off on it if he finds probable cause. Then it goes to the judge, who signs it and returns it to the police. The police then make the arrest. If it’s a relatively minor crime, they’ll call or send a letter to the accused. However, they might show up at the person’s door. If it’s a major crime, they’ll just show up. The person is arrested and either posts a bond and is released, or is held and is brought to court on the next court day where the bond might be increased, decreased or stay the same. Since probable cause has already been found, the court does not have to address that issue.

Being arrested is traumatic and frightening, particularly if you’ve never had any experience with the criminal justice system. Having an experienced attorney is essential in this situation. At the Law Offices of Richard E. Cohen in Hartford, Connecticut, we specialize in criminal defense and have been doing so for almost twenty years. Attorney Richard E. Cohen will aggressively defend you if you are charged with a crime, however big or small. When you’re at your most vulnerable, you need a lawyer can navigate through the criminal justice mine field. Domestic Violence is in the Spotlight

The recent conviction for murder and sentencing of 60 years in prison for James Carter shines an even brighter light on domestic violence and its potential consequences. Connecticut’s criminal justice system takes domestic violence extremely seriously. Once the police receive a call that a domestic violence situation might be present, it is taken out of the hands of the victim. This means that, if later, the victim wishes to “drop the charges”, he or she cannot. The victim does have input as to the prosecution and disposition of the case, but the state will still prosecute it. Therefore, an experienced criminal defense attorney should be employed as soon as possible. The Law Offices of Richard E. Cohen can help.

At the Law Offices of Richard E. Cohen, located at 2 Congress Street in Hartford, personal attention is given to every client. In domestic violence cases, that is vitally important. Diversionary programs are available to some clients. It is also possible to have less serious cases dropped entirely, if the client agrees to undergo anger management counseling. Attorney Richard E. Cohen can keep the client’s record clean. Some of these cases can and do have a happy ending, with the relationship between the parties intact and the client with no criminal record.

Drug Laws in Connecticut – Part One

As many already know, the law concerning marijuana possession has changed. Small amounts have been decriminalized, meaning that a conviction will not result in a criminal record. Possession of less than one-half ounce of marijuana is now an infraction, similar to a traffic ticket, punishable by a fine of $150.

However, larger amounts are still criminal offenses, punishable to up to a year in prison and a fine of up to $1,000.  Possession with Intent to Sell marijuana (designated as “controlled substances”) can result in incarceration of up to seven years.

The Law Offices of Richard E. Cohen is highly experienced in all types of drug cases.  The goal of Attorney Cohen is to obtain alternatives to incarceration, such as drug programs or other alternative sentences.  The legal system are sympathetic to drug users who want to break the cycle of drug abuse.  Although marijuana is not physically addictive, there can be some degree  of psychological dependency, generally due to self-medication, where the user seeks to alleviate physical or mental afflictions by using the drug.

Attorney Richard E. Cohen, located at 2 Congress Street in Hartford, CT, understands the difficulty in breaking the cycle of drug dependence and works with the client as well as the prosecutor and judge in reaching a resolution that does not result in prison or a criminal record.

‘Tis the Season for Drunk Driving Arrests

Law Offices of Richard E. Cohen, With the holidays upon us, many people who are ordinarily careful throw caution to the wind this time of year. Bars, restaurants, Christmas parties and house parties all put temptation to drink to excess in the path of usually cautious people. Police are all too aware of this and are on the lookout for drunk drivers.

It doesn’t help holiday cheer to get arrested for a DUI (or as some refer to it, a DWI, or an OUI – it’s all the same). The penalties are strict in Connecticut. Even a first-time offender can lose his license for at least three months if he or she takes the breath test and fails it, and six months if he or she refuses it.

The Law Offices of Richard E. Cohen has handled these types of cases for almost 20 years. While I can’t guarantee that I will win every case, I might be able to keep you on the road and out of jail. Call us. I am Attorney Richard E. Cohen and I will fight for you.

Sex offenses, sexual assault

There is no criminal charge that can ruin a person’s reputation the way a sex offense accusation can. Besides your reputation, you can spend five, ten or more years in prison if you are convicted of a sexual assault. Many of these sentences require a mandatory minimum time in prison.

At the Law Offices of Richard E. Cohen, these matters are handled with the utmost sensitivity. These matters are complicated. Often, the complaining witness is not being turthful with his or her allegations, but the police seem to believe it just the same, causing the accused to feel “guilty until proven innocent”. And sometimes, the accused has perhaps acted inappropriately but there are extenuating circumstances that need to be brought out. An experienced attorney knows that sex offenses are not black and white.

Call an experienced criminal lawyer. Call Attorney Richard E. Cohen for a free consultation if you’ve been accused of a sex crime. There is too much at stake to handle it yourself or entrust it to an inexperienced lawyer.

Drug Offenses

Although small amounts of marijuana have been decriminalized, it is still a serious crime to be charged with sale or intent to sell any drug, including marijuana. And possession of cocaine, heroin or other drugs is still a felony, punishable by jail time. For example, possession of heroin is punishable by a maximum of seven years in prison. It is important to have an experienced attorney in court when you are faced with the prospect of prison.

At the Law Offices of Richard E. Cohen, we have many years of experience helping clients who are accused of drug crimes. In some cases, an alternative to prison can be found by placing clients in inpatient or outpatient facilities wihich will address their drug dependency issues whithout punishing them. In addition, there are programs that can be uitilized which will save a person from a criminal record and possible incarceration.

Connecticut Criminal Lawyer

The Law Offices of Richard E. Cohen at 2 Congress Street, Hartford, Ct provides first-rate legal assistance to criminal defendants who are accused of any felony or misdemeanor in the state of Connecticut.  No crime is too major or too minor to be given the attorney’s full attention.  If you are looking for a Connecticut criminal defense attorney, please call Attorney Richard E. Cohen at 860-278-9366.  I will always return your calls, and I will see you the same day you call, if necessary.

Drug crimes, sex crimes and domestic violence crimes are among the types of cases I accept.  Every day, people are arrested for a variety of crimes.  Sometimes, they are “overcharged” by the police, in other words, charged for a more serious crime than they actually committed.  This could result in an unfair, overly harsh punishment.  With an experienced criminal lawyer, this won’t happen.  I will thoroughly inspect the prosecutor’s file, including the police report, to make sure that this does not happen.
